NOVEMBER 16, 2023

The Board of Lyon County Commissioners met in Action Session at 9:00 a.m. in the Commission Chambers with the following people in attendance:

Call to Order / Pledge of Allegiance

 

Motion:  To Approve the Agenda as amended.                                                                            Martin/Duft 3-0

 

Motion:  To Approve the Minutes of the 11-17-2023 meeting.                                                     Duft/Peck 3-0   

 

Motion:  To Approve Warrants Payable 11-17-2023 in the amount of $1,030,672.54.               Peck/Duft/3-0

 

Appointments:  Commissioners discussed board appointments.

 

Commissioners discussed the 2024 Lyon County Holiday Schedule.

 

Motion:  To Approve the 2024 Lyon County Holiday Schedule.                                                 Martin/Peck 3-0                                                                                                               

Commissioners discussed the tabled motion on the annexation of property, Industrial Park IV.

 

Motion:  To Remove from the Table the Annexation of Property (Industrial Park IV) as stated on the City of Emporia

                Resolution No. 3696.  To be tabled for the following week November 22, 2023.            Martin/Duft 3-0

 

Motion:  To Re-Table the Annexation of Property (Industrial Park IV) as stated on the City of Emporia Resolution

                No. 3696.  To be tabled for the following week December 7, 2023.                               Martin/Peck 3-0

 

Motion:  To Approve the Minutes of the 11-15-2023 Board of Canvassers meeting.           Peck/Duft 3-0

 

Motion:  To sign the 2023 City/School General Election Abstract of votes cast.                      Martin/Duft 3-0

 

Permits: no action taken.

 

Commissioners discussed the tabled motion for the parking lease agreement with Raise Your Paws.

 

Motion:  To Remove from the Table the Contract with Raise Your Paws and Lyon County, Kansas.              

                Martin/Duft 3-0

 

John Muckenthaler was concerned about the opinion of the Commissioner on this issue.  Stacey Hamman stated the same comments with concerns about access to her property.  Jarem commented on the parking access. 

 

Motion:  To Approve the Lease Agreement for Parking between Raise Your Paws and Lyon County, Kansas.     

                Martin/Duft 3-0

 

Chip Woods presented Commissioners with a request to consider a bid for structural steel beams and galvanized steel bridge planks.

 

Motion:  To Approve the low bid from Welborn Sales, Inc., for Structural Steel Beams in the amount of $58,340.52 to be

                paid from Fund 033-00-8350.                                                        Duft/Martin 3-0                                                                                                               

Motion:  To Approve the low bid for Galvanized Steel Bridge Planks from Welborn Sales, Inc., in the amount of

                $100,762.50 to be paid from Fund 033-00-8230.                           Duft/Peck 3-0

 

Jim Brull, Bruce Boettcher, and Dan Williams presented Commissioners with change orders for the Road & Bridge Project.

 

Motion:  To Approve Change Order #11: relocation support structure for air handling unit due to increased crane depth

                in the Shop Building; Add $1,900.29 to be paid from Fund 044-00-9026.            Martin/Peck 3-0

 

Motion:  To Approve Change Order #13:  corrected work: remove non-FEMA rated door at IT Room and install new

                FEMA rated door, due to design discrepancy by BG: upon approval of change order, BG shall reimburse

                Lyon County $3,828.00 for this corrective work.  Add $9,713.00 to be paid from Fund 044-00-9026.

Motion:  To move to Legal Executive Session to discuss security measures with Commissioners, Ruth Wheeler, Judge

                Wheeler, Chuck Boyce, Jean Barnett, Jamie Williams, Vici Smith, and Counselor Priest, to return at 10:55 a.m.

Motion:  To move to Legal Executive Session with Commissioners, Dan Williams, Vici Smith and Counselor Priest, to
