LYON COUNTY COMMISSION MINUTES

SEPTEMBER 28, 2023

The Board of Lyon County Commissioners met in Action Session at 9:00 a.m. in the Commission Chambers with the following people in attendance:

Call to order / Pledge of Allegiance

 

Motion:  To Approve the Agenda as presented.                                                                         Martin/Duft 3-0

Motion: To Approve Warrants Payable 9-29-2023 in the amount of $158,808.09                     Peck/Duft 3-0

 

Motion:  To Approve Payroll Payable 9-29-2023 in the amount of $354,545.68                       Martin/Duft 3-0

 

Motion:  To Approve Payroll Withholdings Payable 9-29-2023 in the amount of $229,876.27         Martin/Peck 3-0

 

Appointments:  Council on aging has appointed a member to the silver hair legislature.  A letter of resignation has been received from Tony Haag.  He will be resigning from the Olpe Recreation Park Board effective immediately.  His position was scheduled to expire on December 31, 2025.  A request to fill this vacancy and be placed on the board has been received from Ryan Gasche.

 

Motion:  To appoint Ryan Gasche to the Olpe Recreation Park Board effective immediately with a term expiring on

                December 31, 2025.                                                                           Martin/Duft 3-0

 

Personnel changes:  Information for commissioners to review.  Erin Rodriguez, Director of Operations with Lyon County Community Corrections, has been named as interim Director for Community Corrections.  This will take effect on October 5, 2023.

 

Permits:  Deputy Clerk Torres presented an application for a Cereal Malt Beverage License from David A. Mendiola for an event on October 1, 2023, that will be from 1:00 p.m. to 9:00 p.m.

 

Motion:  To Approve the Cereal Malt Beverage License Permit No. 115983 for David A. Mendiola for an event on

                October 1, 2023, from 1:00 p.m. to 9:00 p.m.                                                            Martin/Duft 3-0

 

Tobey Kelly presented Commissioners with a request to consider the invoice from Traffic Control Services.  This invoice is for a car to replace a sheriff’s pickup that was totaled in an accident.  A car is the only vehicle available to replace the wrecked truck.  This amount is to come out of the Multi Year Fund which will mostly be reimbursed by insurance funds.

 

Motion:  To Approve the invoice from Traffic Control Services, Inc. for a 2023 Dodge Charger in the amount of

                 $42,030.00 to be paid from Fund 017-00-9016.                                              Peck/Duft 3-0

 

Jeff Spencer and Seth Snyder presented Commissioners with a request to consider the purchase of a crack sealer machine.  This is a new machine that will be available as early as Monday of next week.

 

Motion:  To Approve the purchase of a crack sealer machine from CRAFCO Inc. at the Sourcewell amount of

                 $65,540.40 to be paid from the Multi Year Fund 017-00-9026.                            Duft/Martin 3-0

 

Reports
Commissioner Martin:

  • I attended the Council on Aging meeting Monday afternoon at the Annex.
  • I will be attending a meeting on Tuesday at the Anderson Building. It will be an informational meeting on the subject of Medicare.  This meeting will be sponsored by the Newman Hospital, Haag Pharmacy and several other agencies.
  • Next week on October 4, will be the JDAC meeting and construction company appreciation luncheon.

 

Commissioner Peck:

  • Next Tuesday will be at community corrections at noon.
  • Next Wednesday will be at the Road and Bridge luncheon.
  • Next Saturday on October 7 will be the Allen Veterans Festival all day.

 

Commissioner Duft:

  • I attended the farm bureau annual meeting last night.
  • There will be a pie auction Sunday at the American Legion at 5:30 p.m.
  • I will be attending the Road and Bridge luncheon next Wednesday.
  • I have a meeting I will be attending tonight with the chamber.

 

Deputy Torres:

  • No Report.

 

Counselor Priest:

  • I will be at JDAC and Road & Bridge on Wednesday.
  • We have a public building commission on Tuesday at 4:00 p.m.

 

Controller Williams:

  • Sales tax numbers are up.
  • I attended the Road and Bridge meeting on Tuesday.
  • I will be attending the JDAC meeting.

 

Public comment:  No one present.

Justin Givens presented Commissioners with a request to consider two resolutions related to the annexation of property.  After much discussion, it was decided to table the first request adopting a resolution which involved the annexation of Industrial Park IV as stated on Emporia City Resolution No. 3696.  The commission raised a concern as to the right of way located around the land to be annexed.  It was decided to accept the second request adopting a resolution which involved the annexation of 1100 S. Hwy 88 as stated on Emporia Resolution No. 3705.

 

Motion:  To table the first item considering the annexation of property (Industrial Park IV) as stated on Emporia City

                Resolution No. 3696.  This will be for 30 days, until clarification can be gained by both parties involved as

                to what actually needs to be done.                                                                     Martin/Duft 3-0

 

Motion:  To Adopt Resolution 15-23, a Resolution finding and determining that the requested annexation of property

                (1100 S. Hwy 99) will not hinder or prevent the proper growth and development of the area or that of any

                 other incorporated city located in Lyon County.                                                  Martin/Duft 3-0

 

Sam Seeley & Michael Reed presented Commissioners with a very informative presentation which included a report on permits and projects in progress.  This report also included information on signs in Lyon County.  Information such as the total number of signs, dimensions and conditions of signs was given in this report.  To conclude this presentation, information on Lyon County violations and Lyon County Address requests within the last year was presented to the Commissioners.

 

Dan Williams presented Commissioners with a request to consider republishing the Amended Lyon County 2023 Multi Year Budget.  The expenditure budget for 2023 is $3,388,213 and the proposed amended expenditures amount is increased to $4,100,00.  This does not mean that the county will spend this amount, it just increases the budget authority to this amount.

 

Motion:  To Approve Republishing the Amended 2023 Multi Year Budget as presented.                    Peck/Duft 3-0

 

Motion:  To move to Non-Elected Personnel Executive Session with Commissioners, Counselor Priest and

                Vici Smith to return at or around 10:50 a.m.                                                          Martin/Duft 3-0
